Your data is used to: process your order and shipping, send you the confirmation email, answer questions about your purchase, operate the game and generate your reports, and send you Market Fortune Society communications if you voluntarily subscribe.
In addition, your gameplay and evaluation data is used to improve the product, conduct research, develop new services, generate benchmarks, and for the development and training of Market Fortune LLC artificial intelligence models and systems, including in aggregated, anonymized or pseudonymized form and for commercial purposes.
Your personally identifiable data remains yours. By using the app and accepting this Policy and the Terms, you grant Market Fortune LLC a worldwide, perpetual, irrevocable, royalty-free, sublicensable and transferable license to use, host, process, analyze, aggregate, anonymize, create derivative works from, commercialize and train models and artificial intelligence with your gameplay and evaluation data, without restriction, without any confidentiality agreement and without compensation to you. This is an informed consent that you grant freely and expressly.
All derived data (Fortune Index, WPA, the twelve decision variables, formulas, reports, analyses, statistics, insights and cohort benchmarks) is the exclusive property of Market Fortune LLC and David May Anaya. You acquire no right, title or interest in this derived data. The method, the algorithms, the metrics system and the app are protected intellectual property of the company.
Scope by nature of the data. The perpetual and irrevocable character of this license applies in full to aggregated, anonymized or pseudonymized data and to the derived data, which no longer identify you and to which personal data protection laws no longer apply. Over your personally identifiable data, the license operates for as long as a valid legal basis exists and respects the mandatory rights described in sections 6 and 7, including erasure going forward. Exercising those rights does not affect processing already lawfully carried out nor data that has already been aggregated, anonymized or turned into derived data by that date.
We share data only with providers needed to deliver the service:
We do not sell, rent, or transfer your personally identifiable data to third parties for commercial purposes. This is distinct from the use of gameplay, evaluation and derived data in aggregated or anonymized form, which Market Fortune LLC may commercially exploit under section 3.
We process your personal data on the following legal bases: your consent, given freely, on an informed basis and expressly when you create your account, log in and accept this Policy and the Terms; the performance of the contract needed to process your purchase, shipping and the operation of the game; the legitimate interest of Market Fortune LLC in improving the product, conducting research, generating benchmarks and developing its systems, balanced against your rights; and compliance with legal obligations where applicable. You may withdraw your consent at any time, with effect going forward, without affecting the lawfulness of prior processing.
As the owner of your personal data, and in accordance with the Habeas Data regime (Law 1581 of 2012 in Colombia), the GDPR and the UK GDPR for users in the European Union, the European Economic Area and the United Kingdom, and applicable privacy laws in the United States, you may exercise the following rights at any time:
Erasure or withdrawal operates going forward over your personally identifiable data and does not affect processing already lawfully carried out nor gameplay, evaluation or derived data that has been aggregated or anonymized and no longer identifies you. If you believe we did not address your request, you may lodge a complaint with the competent supervisory authority (the Superintendency of Industry and Commerce in Colombia, or your data protection authority in the European Union, the EEA or the United Kingdom).
If you reside in the European Union, the European Economic Area or the United Kingdom, your information is processed in accordance with the General Data Protection Regulation (GDPR) and the UK GDPR. If you reside in Colombia, it is processed in accordance with Law 1581 of 2012 and its implementing regulations. For these users, the rights listed in section 6 are mandatory and are not waived by any clause of this Policy or the Terms, and prevail over any license granted over your personally identifiable data.

Automated decisions. Market Fortune does not make automated decisions that produce significant legal effects on you without a valid legal basis. The profiling that generates your reports, the Fortune Index, the WPA and the twelve decision variables is a service you request and expect from the product: it describes your performance within the game, does not classify you for credit, employment, insurance or any other external decision with legal effect, and does not replace your judgment.
When a company books a session for its team, processing changes and these rules override the sections above.
Our own prior authorization. Market Fortune LLC collects authorization directly from each participant, before the session, on a prior, express and informed basis. The company does not collect it and does not replace it with an internal instruction. Participation is voluntary: no one is required to play, to authorize delivery of their individual report or to have their name appear, and declining or withdrawing carries no consequence for their employment.
Who receives what. The identified individual report goes to the participant. The company receives the cohort summary, where references are by role and never by name. The company receives an identified individual report only for those who authorized it specifically and separately.
Minimum cohorts. No summary is issued for fewer than eight participants, and no result is broken down by area, role, seniority, age, sex, origin or any analogous category with fewer than five people. Only the person leading a variable is named, and only if they authorized it. Anyone below the mean is never named and never made identifiable.
Prohibited use. Reports are delivered with an express prohibition on using them, alone or combined with other information, as a total or partial criterion to hire, select, promote, compensate, reassign, sanction or dismiss anyone, or to feed any automated system that makes or assists those decisions. The receiving company is responsible for the use it makes of them.
Limit on the section 3 license. The broad gameplay data license does not extend to identifiable data of corporate session participants. That data is used only to produce the reports for that session, and any later use for benchmarking, research or model training is done solely in aggregated or anonymized form.
What we never do. We do not infer emotions, moods or health conditions. We do not produce diagnoses. We do not administer or interpret psychological tests. We do not provide personnel selection or job placement services.
